The Court invalidates King Misuzulu’s Crowning.
Last year
August King Misuzulu ka Zwelinthini won the succession battle and had his traditional
coronation and was later crowned the king of the Zulu Kingdom by President
Cyril Ramaphosa.
However,
the Pretoria High Court has ruled the crowning of the Zulu King as unlawful and
invalid after the royal family approached the court stating that the rightful heir
to the throne should be Prince Mbonisi Zulu and not King Misuzulu.
Judge N
Davis stated that the recognition of the Zulu King stated in the Government Gazette
no 46057 of 17 March 2022 should be set aside as it is invalid and unlawful.
The Judge
requested that President Cyril Ramaphosa to act in accordance with the terms of
Section 8(4) and 8(5) of the traditional and Khoi-San leadership Act 3 of 2019
and requested for the President to conduct an investigation and provide a
report in respect of the current ongoing allegations.
With all
this being said the Judgement is not to dethrone the current Zulu King Misuzulu
ka Zwelinthini as this was not what the applicants where contesting in court. What
was brought to court was whether the Zulu customs where followed when the King
was crowned and whether President Cyril Ramaphosa acted in accordance with the
act when appointing the King.
